Alcohol ‘Tip Out’ Powers in Northern Territory

In the NT, certain officers can require open alcohol to be surrendered and may tip it out (dispose of it) in prohibited public places and alcohol protected areas. People may also be fined for nuisance public drinking in those places. This page explains who has powers, where they apply, and your rights.

Who can ‘tip out’ alcohol

  • NT Police officers - seize and tip out alcohol, issue fines, and issue fines for nuisance public drinking.
  • Transit officers - tip out alcohol in prohibited transport locations.
  • Public Order Response Units (PORU) - appointed Liquor Inspectors can tip out alcohol in prohibited public and transport locations.
  • Licensing inspectors - enforce Liquor Act at licensed premises; some appointed officers have similar powers.

Where do ‘tip out’ powers apply

  • Prohibited public places - NT towns/cities and any public place within 2km of a licensed venue.
  • Alcohol Protected Areas (dry areas) - illegal to bring, possess or drink alcohol unless exempt (opt-out model until Feb 2027)
  • Public transport locations - stations, bus stops, transit areas.

What can officers do

  • Direct you to stop drinking and surrender alcohol in prohibited places.
  • Tip out opened containers; seize unopened if needed.
  • Issue fine or Banned Drinker Orders, arrest for serious breaches.
  • Seize liquoras evidence under the Liquor Act.

Exemptions and local rules

Some areas allow drinking at set times (e.g., East Point, Nightcliff Foreshore, Mindil Beach during markets). Even there, nuisance drinking can lead to penalties.
